Travel Tales Concierge Terms and Conditions
1. **Introduction**
These Terms and Conditions govern your use of the Travel Tales Concierge platform ("Platform") operated by Travel Tales Concierge ("Company"). By accessing or using our Platform, you agree to be bound by these Terms and Conditions.
2. **Platform Services**
Our Platform serves as a marketplace for curated tours operated by local professional guides, boat rentals, accommodations, and related services. We facilitate transactions between customers ("Users") and vendors ("Vendors"), catering to both Business-to-Consumer (B2C) and Business-to-Business (B2B) segments.
3. **Service Fees**
a. For every booking made through the Travel Tales Concierge platform, Users will be charged a service fee equivalent to 10% of the total order value.
b. Vendors (B2B) will also be charged a service fee equivalent to 10% of every booking they receive through our platform.
4. **Booking and Payments**
a. Users can make bookings through our Platform by selecting desired tours, rentals, or accommodations and completing the payment process.
b. Payments are processed securely through our designated payment gateway.
c. All bookings are subject to availability and confirmation by the respective Vendor.
5. **Cancellations and Refunds**
a. Users may cancel bookings subject to the cancellation policy specified by the respective Vendor.
b. Refunds, if applicable, will be processed according to the Vendor's cancellation policy and may be subject to deductions, including service fees.
6. **User Responsibilities**
a. Users are responsible for providing accurate and complete information during the booking process.
b. Users must comply with all applicable laws, regulations, and Vendor policies while using our Platform and participating in booked activities.
7. **Vendor Responsibilities**
a. Vendors are responsible for fulfilling bookings made through our Platform in accordance with the terms specified in their listings.
b. Vendors must maintain accurate availability, pricing, and other relevant information on their listings.
c. Vendors must adhere to our service fee policy and promptly settle any fees owed to the Company.
8. **Intellectual Property**
a. The Platform and its content, including but not limited to logos, trademarks, text, images, and software, are owned or licensed by the Company and protected by intellectual property laws.
b. Users and Vendors may not use, reproduce, or distribute any content from the Platform without prior written consent from the Company.
9. **Limitation of Liability**
a. The Company is not liable for any damages, losses, or injuries arising from Users' or Vendors' use of our Platform or participation in booked activities.
b. The Company's liability is limited to the extent permitted by law and is contingent upon Users and Vendors complying with these Terms and Conditions.
10. **Amendments**
The Company reserves the right to amend these Terms and Conditions at any time without prior notice. Amendments will be effective upon posting on the Platform. Users and Vendors are encouraged to review these Terms and Conditions periodically for updates.
11. **Governing Law and Jurisdiction**
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Republic of Tanzania. Any disputes arising out of or relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of United Republic of Tanzania.
